俄亥俄州理论上恢复了对留学生和工作签证的CCW

俄亥俄州2015年3月20日后禁止了对非移民签证的隐蔽持枪证颁发。

然而这几个月来已经有不同county好几个F1持有者得到了CCW。 为了避免同学们不重蹈亚利桑那州的覆辙，我直接向俄亥俄州总监察长办公室（AG）进行了询问，对方拒绝了书面答复但给予了口头答复。 核心内容包括：

1）county sheriff 有颁发的决定权，俄亥俄现任AG 不干涉这个权力。
2) 只要符合最新的俄亥俄州AG CCW手册，就可以申请CCW

"To obtain an Ohio Concealed Carry License, the following must also be true:
....
If you are a nonimmigrant who is legally in the United States, you must have been lawfully admitted to the United States without a nonimmigrant visa or you were lawfully admitted under a nonimmigrant visa as defined in the federal Immigration and Nationality Act, 8 U.S.C. 1101(a)(26) and fall within one of the exceptions listed in 18 U.S.C. 922(y)(2)."

那么根据18 USC 922 y (2)(A)

(2)Exceptions.—Subsections (d)(5)(B), (g)(5)(B), and (s)(3)(B)(v)(II) do not apply to any alien who has been lawfully admitted to the United States under a nonimmigrant visa, if that alien is—(A)admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States;

拿到俄亥俄州的猎照就可以申请CCW。

而俄亥俄州猎照要求如下(http://wildlife.ohiodnr.gov/hunting-trapping-and-shooting-sports/hunting-trapping-regulations/licenses-and-permits) ：

1. 21岁
2. Ohio residency， 并明确指出： Ohio Residency Status： An Ohio resident is a person who has resided in the state of Ohio for the past six consecutive months. All others are considered nonresidents and must purchase a nonresident license.

那么基于这个基础。 任何要申请Ohio CCW 的 非移民签证需要满足以下条件。

1. 确认自己是俄亥俄州居民（居住六个月以上）
2. 考取俄亥俄州的猎照
3. 上俄亥俄州CCW课程
4. 在county shierff 哪里填俄亥俄CCW申请表时11 选 yes, 12选 yes, 并打印一份 4473 及解释在身上 （链接在此： https://www.atf.gov/firearms/doc ... form-53009/download）

5. 向申请的出示4473的问题解释单据

并指出12d 和 18c的指向 （ 最好高亮） 然后出示猎照和 CCW 课程结业证明.

以此获得CCW。

Yes, in DEC of 2016, when I applied CCW in Delaware country, I asked the guy who is in charge of CCW application the same question. I got the same answer as you stated above. They do not care if you are on F1 visa. But who knows, things may change.

License Requirements
A permanent customer identification number will be assigned to all applicants of hunting or fishing licenses.
Every youth and adult who applies for any license or permit is required to provide their Social Security Number (SSN). Federal Statute 42 requires the SSN of any individual to whom the state issues a recreational hunting or fishing license. Applicants must also declare their residency and provide their full name, date of birth, gender, mailing address, height, weight, hair color, and eye color. Once provided and recorded in the licensing system, applicants will only be required to update their information on file if it changes.
If applicants do not have an active SSN, they must submit written verification on form DNR 9151, available at wildohio.gov or by calling 1-800-WILDLIFE (1-800 945- 3543). Upon receipt of this form, the Ohio Division of Wildlife will issue an official customer identification number for use in obtaining hunting and fishing licenses or completing landowner game check.
Non-U.S. citizens who are also nonresidents of Ohio will be asked for an alternative form of identification as a substitute for the SSN.

Ohio Residency Status
An Ohio resident is a person who has resided in the state of Ohio for the past six consecutive months. All others are considered nonresidents and must purchase a nonresident license.

person 不包括任何身份界定。

按照Ohio Department of Natural Resources在猎照购买页面上的定义，必须要有在俄亥俄的legal permanent home address，在本地有房或上学不是充分条件:"Any person who does not claim resident privileges in another state or country, and whose actual residence and legal permanent home address are both in Ohio, and have been for at least 6 months before applying for the permit. Owning real estate or attending an Ohio school does not in itself make you a legal resident."
这就是我最担心的地方，作为一个非移民签证持有者，我在俄亥俄到底有没有"permanent home address"呢？我的永久住址是不是应该在中国呢？

只要求住六个月，和ODNR的说法有点矛盾。为了保险起见我买了一张nonresident的证。

所以说看怎么说， 当有冲突时候，律师按无罪辩护应该没大问题。

而且俄亥俄又不是AZ，对这个并不是太在乎。
